Terms of Use
These Terms of Use ("Terms") govern your use of the MyPlants mobile application and website (myplantsapp.com), operated by MyPlants App Ltd ("MyPlants", "we", "us", or "our"), a company registered in England and Wales.
By using MyPlants, you agree to these Terms. If you do not agree, please do not use the app.
1. Eligibility
You must be at least 13 years old to use MyPlants. By using the app, you confirm that you meet this requirement. If you are under 18, you should have the permission of a parent or guardian.
2. Your account
You sign in to MyPlants using your Google account. You are responsible for maintaining the security of your account and for all activity that occurs under it. Please notify us immediately at hello@myplantsapp.com if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Use of the service
MyPlants is provided for personal, non-commercial use. You agree not to:
- Use the app for any unlawful purpose
- Attempt to gain unauthorised access to any part of the service or its infrastructure
- Upload content that is offensive, harmful, or infringes the rights of others
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Use the app in any way that could damage, overload, or impair the service
4. AI features and plant care guidance
MyPlants uses AI to assist with plant identification and care guidance. This information is provided for general guidance only and should not be treated as professional horticultural advice. AI suggestions may not always be accurate.
You should use your own judgement when caring for your plants. MyPlants is not responsible for any plant loss or damage resulting from following suggestions made by the app.
5. Household features
MyPlants allows you to create or join shared households. When you share a household with others, they can view and interact with the plant data in that household. You are responsible for only sharing households with people you trust. You can leave a household at any time.
6. Your content
You retain ownership of the photos and content you upload to MyPlants. By uploading content, you grant MyPlants a limited licence to store and display that content within the app for the purpose of providing the service.
You confirm that any content you upload does not infringe the rights of any third party.
7. Intellectual property
The MyPlants app, its design, logo, and all associated content are the property of MyPlants App Ltd and are protected by UK and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the app without our written permission.
8. Availability and changes
We aim to keep MyPlants available at all times but cannot guarantee uninterrupted service. We may update, modify, or discontinue features of the app at any time. We will give reasonable notice of significant changes where possible.
9. Paid features
MyPlants may offer premium features for a fee in the future. Any paid features will be clearly labelled, and charges will be confirmed before purchase. Payments are handled by Google Play and are subject to Google's payment terms. Refunds are governed by Google Play's refund policy.
10. Disclaimer of warranties
MyPlants is provided "as is" without warranties of any kind, express or implied. We do not warrant that the app will be error-free, uninterrupted, or that AI-generated suggestions will be accurate or suitable for your specific plants.
11. Limitation of liability
To the maximum extent permitted by law, MyPlants App Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app. Our total liability to you for any claim arising from your use of MyPlants shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under English law.
12. Governing law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to these Terms
We may update these Terms from time to time. We will notify you of significant changes via the app or by email. Continued use of the app after changes are posted constitutes acceptance of the updated Terms.
